We understand the importance of finding solutions that work for you and your family when faced with a separation or divorce.
It can be a very stressful and emotional time for families: the last thing any family needs is for the separation or divorce to drag on and cost money they simply cannot afford to spend, especially when setting up two separate households.
At Mediated Family Results we want to help you find solutions that work for you and your family in the least stressful, most time efficient and cost effective manner. Our goal is to reduce conflict, preserve relationships and equip families with the tools they need to deal with any future issues that may arise.
Our mediators are results-oriented, experienced, skilled and sensitive to the heightened needs of families going through a separation or divorce. We want to help you work together to negotiate and resolve your family disputes by reaching agreements outside of court.
Often, following a separation, the most pressing concern for parents is where the children will live and how each of them will be able to continue to be a part of the children’s upbringing. Our mediators are highly experienced in assisting parents with putting together a plan for the continued care, responsibility, needs and residential schedule of the children which is tailored to the specific needs of the family; practical and easy to follow for parents; and encourages predictability and consistency for children.
While our mediators can assist parents with their parenting plans, our parenting coordinator is highly experienced in assisting parents with any issues that may arise in the implementation of their parenting plan, whether big or small. Our parenting coordinator will help parents overcome these hurdles, minimize conflict and remain child-focussed throughout the process so that their children benefit from seeing their parents work together.
If the parent with whom a child resides intends to relocate their residence to a place where it would be difficult for the other parent to continue to have access with the child based on their current schedule, many challenges arise. We can work with families to find a solution that is in the best interests of the child and preserves the child’s relationship with each parent.
When a parent intends to travel with the child or children outside of the agreed upon geographical boundaries or outside of the national borders, and requires the other parent’s consent to travel, we can assist in situations where that consent may not be forthcoming and parents wish to discuss terms of travel or mediate agreements respecting travel terms to avoid any future issues or uncertainties.
Generally, child support is the monthly financial support paid by a non-custodial parent to a custodial parent for the benefit of a child or children following a breakdown of the relationship. Child support is the child’s legal right. The Child Support Guidelines are legislated guidelines that determine how much monthly child support must be paid by a non-custodial parent based on his or her gross income from all sources.
Spousal support is the money that one spouse/partner may have to pay to the other spouse/partner for their financial support following a separation or divorce. Spousal support is usually paid on a monthly basis or it can be paid as a lump sum payment. The Spousal Support Advisory Guidelines are not legislated guidelines but they do provide a range and duration of spousal support payable, with or without children.
There may be a change in the circumstances of a parent, child or spouse/partner that would necessitate a change in either child or spousal support. If you believe that one of these circumstances has taken place, such as a change in the residence of the children, the payor’s income or the recipient’s remarriage, contact our mediators to assist you in discussing these changes and the variation of an existing support agreement or order in a cost-effective manner.
Pets often take the central seat in people’s lives. When pet owners separate many questions arise on the care and time a party gets to spend with their pet. Mediation is an effective way to address pet-related concerns post-separation.
Division of assets can often be challenging, especially given that different rules apply to married spouses as opposed to common-law couples. Many couples get stuck on who gets what, or who is responsible for what debt. Mediating these issues can streamline the process and make it more cost-effective.
When a marriage breaks down each party becomes entitled to one-half of the value of net family property accumulated during the marriage which is carried out through an equalization payment. The equalization payment represents one-half of the difference between each spouse’s net worth at the time of separation. Determining who is entitled to an equalization payment and what that amount will be can often be complicated and requires tactful negotiation. Our mediators have the experience and skills needed to help you through this process so that you can make decisions with clarity and understanding.
The Matrimonial home is the family home in which married spouses were ordinarily living at the time of their separation. There can be more than one Matrimonial home, including family cottages or other vacation properties outside of Canada. We can help families come to an agreement regarding the occupation and/or sale of the Matrimonial home that makes sense for their family.
